The Ontario Ministry of Transportation (MTO) identified 900 properties that are required for the construction of The Windsor-Essex Parkway. Owners of affected property have been contacted and the ministry is talking with property owners and learning how we can work together to reach an amicable agreement.
Approximately 350 amicable agreements have made between the ministry and property owners. Offers of compensation are based on market valueMarket value is what a similar property might be expected to sell for on the open market by a willing seller to a willing buyer.. Each property and situation is unique and this is why we work on a case by case basis – not a one size fits all approach.
After purchase, MTO monitors all of our properties to ensure the safety and security of residents.
Property Owners' Rights
Owners’ rights will be fully explained by an MTO Real Estate Officer. Property owners have the right to:
- be treated fairly and equitably
- receive market value for their lands
- receive reasonable out-of-pocket expenses
- request arbitration.
Expropriation
The ministry will continue to negotiate with property owners to seek an amicable agreement. We will expropriateExpropriation is the transfer of lands to a government authority for government required works. With expropriation, while a property owner's consent is not required for the transfer of lands, the property owner is compensated for lands required and reasonable out-of-pocket expenses. only after we have exhausted other ways to reach an agreement.

Expropriation Workshop
An Expropriation Workshop was held on December 3, 2009, for those who have received an invitation and notice of intention to expropriate from the ministry. MTO representatives discussed the package property owners and tenants received and walk through the expropriation process, timelines, and provide individuals the opportunity to ask questions and meet with an MTO Real Estate Officer.
